We take reasonable efforts to maintain and host this site securely but make no explicit representations or warranties regarding your use of the site. These Terms and Conditions are subject to change at any time without notice.

All images, text, designs, graphics, and other materials on this website are owned by and the property of Swoosh Creative. Any unauthorized use, including but not limited to reproduction, distribution, or modification, is strictly prohibited. You may share our materials with clear credit and a link back to the original source but may not claim our work as your own.

Services Provided

Swoosh Creative offers branding, website design, funnel design, and related creative services. Our services include, but are not limited to:

Branding Services

Logo and brand identity design, including primary and secondary logos, icons, and color palettes.

Branding guidelines, including moodboards, typography recommendations, and logo variations.

Deliverables include PNG files, branding guidelines in PDF format, and Adobe Illustrator (AI) files.


Web Design Services

Website, landing page, sales page, and funnel design services.

The design process includes mockup review, requiring client approval before proceeding.

Deliverables include finalized design transfer, basic SEO setup, and mockups.


Client Responsibilities


Clients must provide necessary assets and approvals in a timely manner.

Clients are responsible for acquiring appropriate licenses for fonts and assets used.

Failure to provide required assets may impact project timelines.


Payment Terms

Pricing is agreed upon in writing before work begins.

Projects under $2,000 require a 50% deposit upfront and the remaining 50% due three days before completion.

Projects over $2,000 require multiple payments, typically in three to five installments, with the first due before work begins and the last due three days before completion.

All sales are final; no refunds will be issued.

If a payment is outstanding for more than 30 days, we reserve the right to reschedule your project within the next 30 days.


Unexpected Events & Project Suspension

Clients may request to pause a project at any time by providing written notice (email is acceptable).

No refunds will be issued for paused projects.

Swoosh Creative is not liable for any losses resulting from project suspensions.


Deadlines & Revisions

Timelines are agreed upon before work begins and may only be adjusted under exceptional circumstances.

Clients may not request an earlier deadline after work has begun.

Each project includes up to two revisions per phase; additional revisions incur a charge of $85 per hour.


Ownership & Usage Rights

Upon full payment, clients receive ownership rights to the deliverables for personal and commercial use.

Swoosh Creative retains the right to showcase completed work in portfolios and promotional materials.


Indemnification

Clients agree to indemnify and hold harmless Swoosh Creative from any claims, damages, or liabilities related to their use of the deliverables.


Communication & Support Hours

Business hours are Monday through Friday, 9:00 AM - 5:00 PM Central Time, excluding holidays.


Testimonials & Portfolio Use

Swoosh Creative may use completed work for promotional purposes and may request client testimonials.


Online Shop Terms

By using our shop, you agree to these terms:

You must be of legal age to make a purchase.

You may not use our products for illegal or unauthorized purposes.

All sales are final; no refunds will be issued.


Termination

We reserve the right to terminate your access to our website and services if you violate these terms.


Force Majeure

Neither party is liable for delays due to circumstances beyond their control, such as natural disasters or government actions.

Third-Party Platforms

For WordPress, Showit websites, and Go High Level websites, funnels, or pages, clients are required to have their own personal accounts with these platforms. Swoosh Creative does not provide or manage these accounts, nor do we cover the associated subscription fees. Clients are responsible for selecting and paying for the appropriate plans based on their needs. We recommend reviewing the terms and conditions of WordPress, Showit, and Go High Level to understand their specific requirements and policies.

Maintenance & Consultation

Swoosh Creative does not provide ongoing maintenance services for websites, funnels, or pages after project completion. However, a separate consultation service may be discussed and priced independently once your custom project is delivered.
